Under Minnesota law, there are two types of bribery, both of which are felonies:&#8221;][tm_heading tag=&#8221;h4&#8243; custom_google_font=&#8221;&#8221; text=&#8221;<strong>Regular Bribery.<\/strong> Whoever does any of the following is guilty of bribery:&#8221;][tm_spacer size=&#8221;lg:20&#8243;][\/vc_column][\/vc_row][vc_row][vc_column width=&#8221;1\/12&#8243; offset=&#8221;vc_col-lg-1&#8243;][\/vc_column][vc_column width=&#8221;5\/6&#8243; offset=&#8221;vc_col-lg-10&#8243;][tm_list list_style=&#8221;manual-numbered&#8221; marker_color=&#8221;secondary&#8221; columns=&#8221;xs:1;lg:1&#8243; items=&#8221;%5B%7B%22item_title%22%3A%22A)%5Ct%20%20Offers%2C%20gives%2C%20or%20promises%20to%20give%2C%20directly%20or%20indirectly%2C%20to%20a%20public%20officer%20or%20employee%2C%20a%20benefit%2C%20reward%2C%20or%20consideration%2C%20that%20the%20public%20officer%20or%20employee%20isn%E2%80%99t%20entitled%20to%20get%2C%20with%20the%20purpose%20of%20influencing%20that%20public%20officer%20or%20employee%20in%20their%20job%20or%20position%3B%22%2C%22icon_simple_line%22%3A%22icon-arrow-1-circle-down%22%7D%5D&#8221;][tm_list list_style=&#8221;manual-numbered&#8221; marker_color=&#8221;secondary&#8221; columns=&#8221;xs:1;lg:1&#8243; items=&#8221;%5B%7B%22item_title%22%3A%22B)%5Ct%20%20If%20the%20person%20IS%20a%20public%20officer%20or%20employee%2C%20and%20they%20request%2C%20receive%2C%20or%20agree%20to%20receive%20some%20reward%20or%20consideration%20with%20the%20understanding%20that%20it%20will%20influence%20the%20decisions%20they%20make%3B%22%2C%22icon_simple_line%22%3A%22icon-arrow-1-circle-down%22%7D%5D&#8221;][tm_list list_style=&#8221;manual-numbered&#8221; marker_color=&#8221;secondary&#8221; columns=&#8221;xs:1;lg:1&#8243; items=&#8221;%5B%7B%22item_title%22%3A%22C)%5Ct%20%20%20%20Giving%2C%20offering%20or%20promising%20to%20give%2C%20directly%20or%20indirectly%2C%20some%20sort%20of%20benefit%2C%20reward%2C%20or%20consideration%20to%20a%20witness%20before%20any%20judge%20or%20in%20any%20hearing%2C%20for%20the%20purpose%20of%20influencing%20their%20testimony%3B%22%2C%22icon_simple_line%22%3A%22icon-arrow-1-circle-down%22%7D%5D&#8221;][tm_list list_style=&#8221;manual-numbered&#8221; marker_color=&#8221;secondary&#8221; columns=&#8221;xs:1;lg:1&#8243; items=&#8221;%5B%7B%22item_title%22%3A%22D)%5Ct%20%20%20%20If%20the%20person%20IS%20a%20witness%2C%20and%20agrees%20to%20take%20a%20benefit%2C%20reward%2C%20or%20consideration%20for%20the%20purpose%20of%20influencing%20their%20testimony%3B%22%2C%22icon_simple_line%22%3A%22icon-arrow-1-circle-down%22%7D%5D&#8221;][tm_list list_style=&#8221;manual-numbered&#8221; marker_color=&#8221;secondary&#8221; columns=&#8221;xs:1;lg:1&#8243; items=&#8221;%5B%7B%22item_title%22%3A%22E)%5Ct%20%20%20%20If%20the%20person%20has%20some%20information%20that%20would%20lead%20to%20the%20prosecution%20of%20a%20crime%2C%20and%20they%20accept%2C%20directly%20or%20indirectly%2C%20some%20kind%20of%20benefit%2C%20reward%2C%20or%20consideration%20to%20keep%20it%20quiet.%22%2C%22icon_simple_line%22%3A%22icon-arrow-1-circle-down%22%7D%5D&#8221;][\/vc_column][\/vc_row][vc_row][vc_column][tm_heading tag=&#8221;p&#8221; custom_google_font=&#8221;&#8221; text=&#8221;<strong>Commercial Bribery<\/strong> which is a special subset of regular bribery, focuses on <mark>unlawful influence in the business setting.<\/mark> Under this statute, it is a crime if an \u201cactor,\u201d usually an employee or contractor, offers, gives, or agrees to give, directly or indirectly, any benefit, compensation, or reward to their employer, or \u201cprincipal\u201d for the purpose of influencing their performance of duties within the scope of that business.&#8221;][tm_heading tag=&#8221;p&#8221; custom_google_font=&#8221;&#8221; text=&#8221;Likewise it is also a crime for the boss\/employer\/principal to offer, give, agree to give, indirectly or directly, any benefit, reward, or compensation to an employee, agent, fiduciary, or contractor for the purpose of influencing the performance of their duties in the scope of that business.&#8221;][tm_heading tag=&#8221;p&#8221; custom_google_font=&#8221;&#8221; text=&#8221;<strong>Federal law<\/strong> also has two types of Bribery, and both are similar. He was investigated for taking kickbacks from contractors when he was the Governor of Maryland. He was known for getting wads of cash handed to him in paper sacks as he walked into the Capitol in Annapolis. But bribery of a public official doesn\u2019t always have to involve someone in high office.&#8221;][\/vc_column][vc_column width=&#8221;1\/2&#8243; offset=&#8221;vc_col-lg-6 vc_col-md-6 vc_hidden-sm vc_col-xs-6&#8243;][vc_single_image image=&#8221;278181&#8243; img_size=&#8221;full&#8221; alignment=&#8221;right&#8221;][\/vc_column][\/vc_row][vc_row][vc_column][tm_heading tag=&#8221;p&#8221; custom_google_font=&#8221;&#8221; text=&#8221;Federal law also prohibits bribery of an agent of a program receiving federal funds, which could include lots of people working for non-profit organizations, educational institutions, construction companies, or social programs. Most of the people charged with bribery aren\u2019t famous.&#8221;][tm_heading tag=&#8221;p&#8221; custom_google_font=&#8221;&#8221; text=&#8221;Here\u2019s a real-life example: Mr. Hang was a man working for the Department of Housing and Urban Development. He was charged and convicted of bribery when he was caught getting southeast Asian immigrants to paying him money to accelerate their applications for housing assistance.
