{"id":277894,"date":"2022-02-16T13:27:25","date_gmt":"2022-02-16T19:27:25","guid":{"rendered":"https:\/\/beta10.technodreamcenter.com\/feddefense\/?p=277894"},"modified":"2023-11-13T12:50:11","modified_gmt":"2023-11-13T18:50:11","slug":"assault","status":"publish","type":"post","link":"https:\/\/beta10.technodreamcenter.com\/feddefense\/assault\/","title":{"rendered":"Assault"},"content":{"rendered":"<div class=\"wpb-content-wrapper\"><p>[vc_row][vc_column][tm_heading tag=&#8221;h4&#8243; custom_google_font=&#8221;&#8221; text=&#8221;What is Assault?&#8221;][tm_spacer size=&#8221;lg:20&#8243;][tm_heading tag=&#8221;p&#8221; custom_google_font=&#8221;&#8221; text=&#8221;<mark>Assault is defined as the intention to cause 1) fear of harm or 2) actual harm to another person.<\/mark> The degree of the assault charge depends on the severity of the harm caused, the offender\u2019s prior criminal record, and the identity of the victim of the assault:&#8221;][tm_heading tag=&#8221;p&#8221; custom_google_font=&#8221;&#8221; text=&#8221;1. <strong>Assault in the First degree <\/strong>is charged when the victim is caused great bodily harm, or use of force is used against a police officer or correctional employee;&#8221;][tm_heading tag=&#8221;p&#8221; custom_google_font=&#8221;&#8221; text=&#8221;2. <strong>Assault in the Second degree<\/strong> requires use of a dangerous weapon;&#8221;][tm_heading tag=&#8221;p&#8221; custom_google_font=&#8221;&#8221; text=&#8221;3. <strong>Assault in the Third degree<\/strong> causes \u201csubstantial bodily harm\u201d;&#8221;][tm_heading tag=&#8221;p&#8221; custom_google_font=&#8221;&#8221; text=&#8221;4. <strong>Assault in the Fourth degree<\/strong> is charged when the victim is a police officer or emergency personnel;&#8221;][tm_heading tag=&#8221;p&#8221; custom_google_font=&#8221;&#8221; text=&#8221;5. <strong>Assault in the Fifth degree<\/strong> is usually a misdemeanor and is charged for low-level altercations.&#8221;][tm_heading tag=&#8221;p&#8221; custom_google_font=&#8221;&#8221; text=&#8221;These definitions are used to delineate between different levels of assault, and often the charges can be challenged by an attorney, especially when the state has charged based on the injuries of the victim. For example, \u2018substantial bodily harm\u2019 can be subjective.&#8221;][tm_heading tag=&#8221;p&#8221; custom_google_font=&#8221;&#8221; text=&#8221;<mark>Domestic Assault<\/mark> has the same general definition, except it is charged when the alleged victim of the assault is a member of the offender\u2019s household, family, or with whom the offender has or has had a significant sexual relationship. Therefore, a person can be charged with domestic assault against a former spouse, an ex-lover, a current lover, a child, uncle, brother, aunt or mother.&#8221;][tm_heading tag=&#8221;h4&#8243; custom_google_font=&#8221;&#8221; text=&#8221;Assault crimes are <mark>ENHANCEABLE:<\/mark>&#8220;][tm_spacer size=&#8221;lg:20&#8243;][tm_heading tag=&#8221;p&#8221; custom_google_font=&#8221;&#8221; text=&#8221;Assault crimes, including and especially Domestic Assault, are considered \u201cenhanceable\u201d offenses. This means that every conviction for an assault or assault-related offense makes any future assault-related offense more serious with greater consequences. The look-back period is ten years.
